GLOBAL MOBILITY VISAS sss

Global Business Mobility (GMB) visas came into effect on April 11, 2022, and offers alternative routes for companies that want to expand and open a branch in the UK. To set up a branch/representation in the UK, you will need to appoint and UK Expansion Worker(s) by obtaining the relevant sponsor license.

The company that has obtained the sponsor license can transfer employees who comply with the occupational codes published by the Home Office to start or support its UK activities.

There is no English language requirement.

You must not already be actively trading in the UK. You must, however, show you have a UK ‘footprint’.

UK Expansion Worker Visa, part of the Global Business Mobility route

A UK Expansion Worker visa allows you to come to the UK to set up a branch of an overseas business that has not started trading in the UK yet. •A UK Expansion Worker can come to the UK for up to one year initially, with the option to extend their stay by up to a further year. By updating the sponsor licence, GBM workers can switch to Skilled Worker visa and extend their stay in the UK further and potentially obtain Indefinite Leave to remain. •There can be up to 5 workers to establish the UK business. Once the UK entity establishes and trading starts, the company can add other routes to their licence and sponsor more workers on those routes. •If a person owns a company or company shares in the UK or another country, they may benefit from GMB visas to settle in the UK to establish the UK entity of their company. •UK Expansion Workers must be paid at least the general salary threshold of £42,400 per year, or the specified going rate for the occupation (whichever is higher) • UK Expansion workers can be accompanied or joined by their partner and dependent children if they meet the relevant requirements for dependants.

How Long It Takes to Get a Decision

Once you’ve applied online, proved your identity and provided your documents, you’ll usually get a decision within 3 weeks.

You’ll be contacted if your application will take longer, for example because:

• your supporting documents need to be verified
• you need to attend an interview
• of your personal circumstances, for example if you have a criminal conviction

You may be able to pay to get a faster decision - you’ll be told if you can when you apply.

With your Global Business Mobility Visa

You can: work for your sponsor in the job described in your certificate of sponsorship, study, bring your partner and children with you as your ‘dependants’, if they’re eligible, do voluntary work, travel abroad and return to the UK

Indefinite Leave to Remain (ILR): These routes do not lead to ILR, but it is possible for employees who come with this route to switch to another visa such as Skilled Worker visa to settle in the UK. The company can employ its employees with a Skilled Worker visa by updating its sponsor license.

Other GBM Routes

Senior or Specialist Worker Visa Senior or Specialist Worker visa allows you to come to or stay in the UK to do an eligible job at your employer’s UK branch.

Eligibility
• Be an existing employee of an organisation that’s been approved by the Home Office as a sponsor
• Have a ‘certificate of sponsorship’ from your employer with information about the work you will do in the UK
• Do a job that’s on the list of eligible occupations
• Be paid at least £42,400 per year

Graduate Trainee Visa
Graduate Trainee visa allows you to come to or stay in the UK to work for your employer in their UK branch. Your job must be eligible and part of a graduate training programme for a managerial or specialist role. You cannot apply to change (‘switch’) to a Graduate Trainee visa from inside the UK.

Eligibility
• Be an existing employee of an organisation that’s been approved by the Home Office as a sponsor
• Have worked for your sponsor outside the UK for at least 3 months immediately before you apply
• Have a ‘certificate of sponsorship’ from your employer with information about the work you will do in the UK
• Do a job that’s on the list of eligible occupations
• Be paid at least £23,100 per year

Service Supplier Visa
You can apply for a Service Supplier visa if you have a contract to provide services for a UK company, either as an employee for an overseas company or a self-employed professional based overseas.

Eligibility
• Be an employee of an overseas business, or a self-employed service provider based overseas
• Be providing a service to a UK business under a contract that is covered by a valid international trade agreement
• Be doing an eligible job - if your job is not eligible you may still qualify if you have relevant qualifications and experience
• Have a ‘certificate of sponsorship’ from your UK sponsor with information about the work you’ll be doing in the UK
• Have worked for your employer for at least 12 months outside the UK, or have at least 12 months’ professional experience if you’re a self-employed service provider.
